Refer-a-Friend Terms and Conditions

Introduction

These Refer-a-Friend Terms & Conditions ('the Terms') govern the users ('you' or 'your') use of the website www.yourheights.com ('the Website') and your relationship with BRAINCARE LIMITED, 27 OLD GLOUCESTER STREET, LONDON, WC1N 3AX ('we', 'our', or 'us'). As a Refer-a-Friend member (a “Referrer”), you are subject to these Terms & Conditions for Heights’ Refer-a-Friend program. Please read these terms carefully as they affect your rights and liabilities. If you do not agree to these Terms, please do not access nor use the Website. 1. Qualified Referral

A Qualified Referral is defined as a purchase made at www.yourheights.com by a person (a "Referred Customer") who arrives on Heights’ website and uses your Refer-a-Friend link. You are limited to one Qualified Referral for each Referred Customer; in other words, additional or repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals. The Qualified Referral must be a new customer, i.e. they have not purchased Heights’ products previously.

2. Referred Customer

The Referred Customer and the Referrer cannot be the same person. For instance, you cannot use a different email address.

3. Reward Discounts

The Referrer will receive 20% off their next order, while the Referred Customer will receive 20% off their first order. This is not recurring. There is no maximum Qualified Referrals per calendar year. Once the Referred Customer has purchased a subscription, 20% off their first order will have been auto-applied in their cart and at checkout. Referrers must check their email for confirmation that their friend has purchased a subscription. A code will be attached that Referrers must apply to their next order in their customer portal. 4. Eligibility

Eligibility is limited to individuals only. The Referred Customer must purchase a subscription product, not a one time purchase product. Taxes, discounts, shipping, returns, chargebacks, fraudulent payments, and/or other third party fees do not impact referral eligibility. In addition, Heights’ Refer-a-Friend Program cannot be used by businesses for affiliate lead generation as determined in Heights’ sole discretion.

5. No Spam

You must comply with all up-to-date “SPAM” laws. For instance, emails must be created and distributed in a personal manner and bulk email distribution is strongly discouraged. Any distribution of your referral link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited, and will be grounds for immediate termination of your account and exclusion from Heights’ Refer-a-Friend program.

6. Right to Close Accounts

Heights reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the Heights Refer-a-Friend program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation.

7. Right to Cancel Program or Change Terms

Heights reserves the right to cancel the Refer-a-Friend Program or to change these Terms & Conditions at any time in its sole discretion. Any unclaimed referral discounts will be forfeited at that time.
